Terms of Use

The agreement between you and EchoFrame for using the app and website. It covers your account, what you can and can't do, who owns what, and the limits of our responsibility.

These Terms of Use ("Terms") are a legal agreement between you and Gioel Antoni (an individual sole proprietor in Italy), the operator of EchoFrame ("we", "us"). They govern your use of the EchoFrame mobile app (the "App") and the website at echoframe.help (the "Website", together the "Service").

Please read this carefully

These Terms include important provisions about real-world safety, the content you create, the limits of our liability, and how disputes are handled. If you do not agree, please do not use the Service.

1. Acceptance of these Terms

By creating an account, joining the waitlist, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of someone else, you confirm you are authorised to accept these Terms for them.

2. Eligibility

You must be at least 16 years old to use the Service. By using EchoFrame, you represent that you meet this age requirement and that you are legally able to enter into these Terms. The Service is not available to anyone previously removed from it by us.

3. Your account

  • You must provide accurate information when registering and keep it up to date.
  • You are responsible for keeping your password secure and for all activity that happens under your account.
  • Notify us promptly at support@echoframe.help if you suspect unauthorised use of your account.
  • You may not share, sell or transfer your account, or use someone else's account without permission.
  • One person, one account — do not create accounts by automated means or to evade a block or suspension.

4. Acceptable use & your responsibilities

EchoFrame works because people leave genuine, respectful traces in real places. You agree to use the Service lawfully, respectfully and in line with these Terms, and to be solely responsible for the echoes, comments, messages and other content you create.

Real-world safety is your responsibility

EchoFrame encourages you to walk to physical places to create and discover echoes. You are responsible for your own safety and for obeying all laws. Do not trespass, enter restricted or dangerous areas, ignore traffic or local rules, or put yourself or others at risk to capture or find an echo. Stay aware of your surroundings and never use the Service while driving.

5. Prohibited conduct

Content and behaviour that are never allowed on EchoFrame.

You must not, and must not allow anyone else to:

  • Post content that is illegal, hateful, harassing, threatening, defamatory, or that incites violence.
  • Post sexually explicit content, or any content that sexually exploits or endangers minors — this results in immediate removal and reporting to the authorities.
  • Invade others' privacy: photograph identifiable people in a private setting without consent, reveal someone's home or private location, dox, stalk, or use proximity features to track, follow or harass anyone.
  • Trespass on, or encourage others to enter, private property or restricted areas to create or find echoes.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Post spam, scams, malware, or unsolicited advertising; use the Service for unauthorised commercial purposes (commercial or sponsored echoes require our prior written permission).
  • Upload content you do not have the right to share, or that infringes someone's intellectual-property or other rights.
  • Attempt to defeat the camera-only capture, falsify location, or otherwise game discovery, ratings or rankings.
  • Reverse-engineer, scrape, or use bots or automated means to access the Service; probe, disrupt, overload or breach its security.
  • Circumvent visibility settings, blocks, or any access controls.

We may remove content and suspend or terminate accounts that violate these rules, as described in Section 14.

Zero tolerance for objectionable content and abusive users

There is no tolerance for objectionable content or abusive behaviour on EchoFrame. Every echo, every comment and any person can be reported from inside the app, and you can block any user at any time. Reporting something removes it from your own view immediately. We review every report within 24 hours and remove content — and eject the users responsible — where these Terms have been broken. Content reported by enough people is hidden automatically while we review it. You can also write to support@echoframe.help.

6. Your content & the licence you give us

You keep ownership of the echoes, photos, comments and messages you create ("User Content"). To run the Service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resize or compress), and display your User Content solely to operate and provide the Service — including showing your public echoes to other users according to the visibility you choose.

  • This licence exists only so we can run EchoFrame. We do not sell your content or use it for advertising.
  • When you publish a public echo, you also permit other users to view it within the Service as part of discovery.
  • The licence ends when you delete the content or your account, except for copies that are in the process of being purged from backups, or that we must retain by law.
  • You are responsible for your User Content and represent that you have the rights to share it.

We may remove or restrict User Content that breaches these Terms or the law, but we are under no obligation to monitor content and do not endorse any User Content.

7. Authenticity, camera & location

Echoes can only be created with the in-app camera and are anchored to your device's location at the moment of capture. You agree not to falsify, spoof or manipulate location or capture data. Location and place information may be approximate and depend on your device and third-party map data; we do not guarantee its accuracy.

8. AI-generated content

EchoFrame does not generate content using artificial intelligence and does not currently offer AI features. All content on the Service is created by its users. If we add AI-assisted features in the future, we will update these Terms and the Privacy Policy to describe them.

9. Our intellectual property

The Service itself — including the EchoFrame name, logo, design, software, and all related content we provide — is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App and Website for their intended purpose. You may not copy, modify, distribute, sell or create derivative works from any part of the Service except as these Terms allow.

10. Privacy

Your privacy matters to us. Our Privacy Policy explains what we collect and why, and our Data & Compliance document covers how we meet the GDPR and app-store requirements. By using the Service, you acknowledge that processing of your data as described there.

11. Subscriptions & payments

EchoFrame is free today. These terms apply if and when paid features launch.

Free during beta

EchoFrame is currently free to use. There are no subscriptions or in-app purchases at this time, and creating and discovering echoes will always have a free tier.

In the future we plan to offer an optional paid subscription ("EchoFrame+") that unlocks extra depth and convenience. If and when we do, the following terms apply:

  • Billing through the app stores. Paid features will be sold as in-app purchases through the Apple App Store and Google Play. Your purchase is charged to your store account, and Apple or Google acts as the seller for that transaction.
  • Auto-renewing subscriptions. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple or Google account settings — not by deleting the app.
  • Pricing. Prices and what each plan includes will be shown before you buy. We may change prices for future periods with reasonable notice; changes never affect a period you have already paid for.
  • Refunds. Because the app stores process payments, refunds are handled by Apple or Google under their respective policies. Where you are a consumer in the EU/EEA, your statutory rights — including any right of withdrawal for digital content — continue to apply.
  • No essential paywall. We will not put the core ability to create or discover an echo entirely behind a paywall.

Sponsored places (future). We may also allow businesses, venues or events to place clearly-labelled "verified place" echoes on the map. These will always be visibly marked as such and never disguised as ordinary user echoes, and we will never sell your personal data to them.

We will update these Terms and the Privacy Policy before introducing any paid feature or sponsored content.

12. Service availability & beta status

EchoFrame is under active development and currently offered on a private-beta / early-access basis. Features may change, break or be removed, and the Service may be unavailable from time to time. We provide the Service "as is" and do not guarantee uninterrupted or error-free operation.

13. Changes to the Service & these Terms

We may modify, suspend or discontinue any part of the Service at any time. We may also update these Terms; when changes are material, we will update the effective date and, where appropriate, notify you in the App, on the Website or by email. Continuing to use the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and you may delete your account.

14. Suspension & termination

  • By you: you can stop using the Service and delete your account at any time from Settings → Account → Delete account in the App.
  • By us: we may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or to protect the Service and its users. Where reasonable and lawful, we will give notice.
  • On termination, your right to use the Service ends and your content is deleted as described in the Privacy Policy. Provisions that by their nature should survive (such as intellectual property, disclaimers, liability limits and governing law) will continue to apply.

15. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that echoes, locations, place names or notifications will be accurate, timely or reliable.

Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights you may have in your country of residence.

16. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of (or inability to use) the Service. This includes anything that happens in the physical world while you create or discover echoes — you remain responsible for your own conduct and safety.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited under applicable law. Where liability cannot be fully excluded but can be limited, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or €50.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and reasonable expenses (including legal fees) arising from your User Content, your misuse of the Service, or your breach of these Terms or of someone else's rights. This does not apply to the extent a claim results from our own breach or unlawful conduct.

18. Governing law & disputes

These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. The courts of Italy will have jurisdiction over any dispute — except that, if you are a consumer, you benefit from the mandatory protections of the law of your country of residence and may bring proceedings there where the law allows.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform. We are happy to try to resolve any issue directly first — just contact us.
